These are the Terms and Conditions for Use of the Website of The Myers-Briggs Company Limited, a company registered in England and Wales (registered number 2218212) and cover the European branch offices of The Myers-Briggs Company Limited (including The Myers-Briggs Company - France, The Myers-Briggs Company - Netherlands and The Myers-Briggs Company - Germany). These Terms governs the use of our website and any associated services. When we refer to “The Myers-Briggs Company”, “we”, “us” and “our” we mean The Myers-Briggs Company Limited and our European branch offices, unless otherwise stated.

1. Use of our site

1.1 Your use of this website, including any sites of our European branch offices (“Sites”), is subject to these terms and conditions ("these Conditions").

By using the sites you are agreeing to be bound by these Conditions and our Privacy Policy. If you do not agree to these Conditions, do not use the Sites. In addition, if you purchase any of our goods or services, then that purchase is governed by our Terms of Business (see paragraph 4 below). Please read these; they are important.

1.4 Certain services available through our Sites may be accessible only to users who have pre-registered for the applicable services, including use of our shop. Such users may be allocated registration details by The Myers-Briggs Company, including a log-in and password.

1.5 Users are responsible for ensuring the security of any subscription and registration details provided to them by The Myers-Briggs Company, including log-in and passwords. Registration details, including log-in and password details, shall not be shared between multiple users. Any loss or theft of such details should be reported to The Myers-Briggs Company as soon as possible in order that replacement log-in and passwords may be created.

2. Intellectual property rights

2.1 Except where otherwise indicated, the Material on the Sites is protected by copyright, database rights and other intellectual property rights that belong to The Myers-Briggs Company Limited. All of The Myers-Briggs Company's rights in the content and design of the website are reserved.

2.2 Notwithstanding the above, you may read, print and download material from the website - other than third-party material - free of charge, provided it is:

  • for your private use or for use in the ordinary course of your business;
  • reproduced accurately;
  • not used in a misleading context; and

2.5 Subject to any approval under clause 1.3, if you wish to display OPPassessment sample reports, you should link to the OPPassessment sample reports on our website rather than uploading examples of your own on yours. This ensures that surfers have access to the most recent versions of the documents as we continue to update and revise our materials.

3.1 The Myers-Briggs Company is committed to protecting and respecting Users’ privacy and to acting in compliance with GDPR (the General Data Protection Regulation (EU) 2016/ 679) and any applicable enacting, successor or amending legislation. 4. Purchase of goods and services

4.1 Our Terms of Business apply whenever you wish to order goods or services from us, together with our terms set forth in paragraph 1.4 regarding subscription and registration details.

4.2 In the event of any conflict or inconsistency between these Conditions and our Terms of Business, our Terms of Business will prevail but only to the extent necessary to resolve that conflict or inconsistency.

8. General

8.1 No delay, neglect or forbearance on the part of The Myers-Briggs Company in enforcing any of these Conditions will be or be deemed to be a waiver or in any way prejudice any right of The Myers-Briggs Company.

8.2 If any of these Conditions is, for any reason, held to be unenforceable, illegal or otherwise invalid in any way, the unenforceable, illegal or invalid provision will not affect any other Condition and those Conditions will continue in full force and effect.

8.3 These Conditions are governed by English law and you agree you will only sue us in the courts of England. The place of performance of the contract will be England.

8.4 No addition to or modification of any provision of these Conditions will be binding on The Myers-Briggs Company unless made in writing and signed by its duly authorised representative.

8.5 All customers shall be required, in using The Myers-Briggs Company's Materials to verify any local requirements and/or restrictions on using psychometric tests in general and the Materials in particular, in that jurisdiction, whether imposed by law, regulation or by a local regulatory or governmental body. Where any local requirements and/or restrictions exist that alter the criteria for, or prevent, use of Materials within a particular jurisdiction, it shall be the responsibility of the customer to ensure that it fully complies with any and all such local requirements and/or restrictions. Where any individual or entity uses Materials in a particular jurisdiction in contravention of any local requirements and/or restrictions, whether knowingly or inadvertently, such individual or entity shall be solely responsible and liable for such use and shall hold harmless and indemnify The Myers-Briggs Company in respect of any loss or claim by a third party against The Myers-Briggs Company arising from such. Further, in the event that a customer has failed to ensure that any Materials may be legitimately used within a particular jurisdiction and subsequently purchases Materials for use in that jurisdiction, such customer shall be liable for the costs thereof and The Myers-Briggs Company shall bear no responsibility or liability for return of such Materials or the reimbursement of any associated costs.

8.6 These Conditions were updated in May 2018. The Conditions covers The Myers-Briggs Company Limited and its European branch offices (including The Myers-Briggs Company - France, The Myers-Briggs Company - Netherlands and The Myers-Briggs Company - Germany). The Myers-Briggs Company reserves the right to modify or update these Conditions from time to time without notification to you, so please check it regularly.
